In September, I conversed with a Realtor over a home I had interest for.
I'd inter-acted with a couple of Realtors prior, showing interest in a couple of homes (in Sk) and said that I was window shopping.
Now some of these realtors (in SK), were totally disclosing, contacting me back with every bit of info - things like how much the taxes were, heating bills, electric, if the home needed some work (ie: new shingles in a couple of years etc) I found that to be of good service. Most of the homes I've showed interest in, are in and abouts the same price range.
I was pleased with the "honesty" and ambition for which they communicated.
Alas, I made an offer on one and the Realtor told me to go lower.
We discussed that I was doing my back taxes and was under a little pressure with a dead line on this house, but said that I could extend my stay if the realtor would work with me on it and I had an appointment with the bank on Oct 10th and another later on that week. I couldn't see getting $$$ in my hand before Nov 15th.
All was ok, he asked for a deposit and I sent 10% of the purchase price. He sent me a contract that had nothing we had discussed.
I asked that he disclose that the home needed some work - a new roof in a couple of years and that the basement eventually needed work.
I asked that it be disclosed that the home had a septic and it's own water.
None of that was in the contract and he submitted that I'd have my financing in place by Sept 23rd.... hmmmm - not Nov 15th as we had discussed.
I went to see a Lawyer, as I had showed the contract to the loans officer at the bank.
Now Ab. has some sticky laws concerning home purchases, even though this home was in Sask and the rules are different, however, I was applying in Ab for the loan and not Sk.
In Ab. you need a Building Inspection and other prior to being accepted for a loan unless the home is brand spankin new.
I wanted the conditions stipulated because at the price we had agreed on, it was obvious the home would need some work and so as not to draw too much attention to what it needed, it was just better that certain things be disclosed not to draw too much attention to matters.
I then contacted the Realtor and asked if he could send me names of building inspectors as there was a chance that I'd be asked for one since there was no disclosure on the contract for offer to purchase.
He replied that there was TWO inspectors in the area but would not give me the names! So, I did an internet search and alas I came across their names.
I then spoke to him about the dates and he told me to change them and initial the changes and sign the contract to get it back to him.
Again, I went to see the Lawyer, who said that perhaps it was in my best interest not to sign the contract. So I didn't.
The Realtor called me and agreed to the dates we had discussed and again told me to add in the home's condition, initial it and get it signed and returned as he had several inquiries. I said ok and fibbed that I'd get out the contract later that day. BUT I asked myself, how could I write the home's condition when I never seen it and why hadn't he submitted the dates we had discussed?
The VERY next afternoon, the Realtor sent me an email and told me that the dates were not what he would accept as he had had 3 more emails inquiring about the home (he was thinking that I had signed the contract and that he could keep my deposit!!! - the prick!)
I contacted the Sask Real Estate Board - asking what the procedure was in Sask concerning home purchases (since the realtor said nothing and was just hustling me along) - I wanted an "honest" encounter in detail and never disclosed what was happening with me.
I then emailed the Realtor, stating that I contacted the Real Estate Board as he was not being very honest with me and was not honoring his word. I also brought to point how I was getting more info off of internet searches in comparison to what he would tell me (especially where Building Inspectors were concerned)
I referred him to a link off of the Real Estate Board's website, that stipulated how a Realtor - works for both the Buyer and Seller and asked that he be of more assistance to make the transaction more simplified - not so complicated and out of line.
I haven't heard back from the man ever since I mentioned the REal Estate Board - so I wrote back and told him that I never made mention of our transaction, but frankly, he never discussed the procedure or anything like I had asked. I also wrote that in lieu of the fact that the contract's dates were altered from our discussion, that I felt that perhaps he'd be better off with one of the "several" who were seeking to purchase the home and to return me my deposit.
I stroked a line through the contract and wrote VOID - and on each section where there were dates, I wrote that the dates were not as we had discussed, therefore VOID and sent the top copy back by registered mail. My signature never went on that contract.
That was over 2 weeks ago and I still don't have my deposit back, so now I have to go to a Lawyer and pursue my friggin deposit, which will now hinder me getting another home I am in the middle of discussions over!!!!!
I was told that being the Realtor put the funds into a trust, I could wait a loooooong time for my money back - what a prick!
I will be contacting the Real Estate Board on Tuesday and sending them the emails between the Realtor and I if I have no news by then... now I DO have to file a complaint -just what I needed - just what I needed! Damn!
My payments on homes in the price range I'm looking at, would lock me in at about $200 a month, something I can live with going into my senior years and live comfortably - I don't want to take out a loan at $50,000 and lock myself in at $600 a month for the rest of my life - been there done that and don't need the worry - not interested in living to pay off a home! I want to live a little and fix up a home that way I want it over time and according to my budget.
Why is it that if a person is not spending $100,000 or more, that it is not suiting? Damn some of the homes I've seen would suit me just fine. Not everyone in Ab is a money mongrel and being rural, of course my income dropped but so did the prices on the homes I was purchasing. One was $150 in mortgage payments and the other was $350 - $500 a month for 2 homes - fine by me! And look what happened with that>
How do I do these things to myself!!!???
I need to move and I need my savings back to do that!

Either the little bugger will survive, or a skunk, a coyote or one of the critters here will catch it, but it just didn't seem suiting to let the little bugger drown!
Alas, my water is heated so chores are calling.
