Aboriginal law is very complicated, and I don't pretend to be an expert in it. But after the constitution was repatriated in 1982, aboriginal rights are also found in section 35 of the new Constitution Act Some rights to aboriginals are indeed based on historical links to their land and are "ra... |

Oakley, who stands about five-foot-one and weighs 100 pounds, was subjected to a steady stream of heckling, profane taunts and verbal abuse from parents in the stands at a game between a local team and a visiting squad from Wetaskiwin. Just utterly disgusting. Hockey for kids should be about teamwo... |

Ridenrain, that's a bit much. Are you suggesting the police simply get to search anyone's property whenever they want, no need for warrants at all, our civil liberties be damned? This isn't a case about anything other than sloppy police work. In your first quotation above, you comment on how the pol... |

This case turns on horrible police work. They didn't meet the test for a telewarrant; they did a lazy investigation; and they failed to tell the issuing justice who signed on the search warrant about relevant and material information. To quote the Appeal court: "But here, as I have said, there ... |

An eye for an eye leaves us all blind. While I am very sympathetic to this woman, I cannot even begin to fathom how any civilized country could even consider mutilating people as a form of state sanctioned punishment. Surely we are better than that. We are. They aren't. Take a look at the heading w... |

We shouldn't lose sight of the broader principle behind our justice system. The whole reason to have a Charter or other rules that allow people to beat charges on "technicalities" is so that even if 99 guilty people walk out free, that one innocent person wrongly charged isn't convicted. T... |

Ah, the never never land of domestic violence... where abusers are welcomed back, and victims pretend it never happened. And somehow, we all just accept it. |

The truth is that our judicial system routinely mitigates and/or alleviates judgement when their are mitigating factors and the possibility for rehabilitation . It just doesn't make headlines. When their is family support involved they are more lenient because they recognize that family plays a big... |

There shouldn't be an "other system" in 1 country. Why not? Look at the US model. Look at the authority that each state has. Its almost like they are separate entities as far as the law is concerned unless crimes occur over state lines or certain federal laws are violated. In addition, th... |

What Mount Pleasant Municipal Judge Larry Duffy didn't decide is whether that determination matters under an 1802 South Carolina law that, read literally, makes any game with cards or dice — including popular board games such as Monopoly and Sorry — illegal. Of all the stupid... how do these laws r... |

You can have it both ways, depending on the context. Even where one's Charter rights are violated, the evidence against that person can still be admitted - this is done via section 24(2) of the Charter. The judge will consider how serious a violation of the accused's rights occurred, and how serious... |

So you are in favour of having separate rules and regulations for every group you can think of? Bring on Sharia law... No, the Natives are special cases. Unlike any other group the did not migrate here and their culture exists only in our country (and the US). Try and view their reserves as a seper... |
