The YCJA explicitly states the primary goals of sentencing for young persons are rehabilitation and reintegration into society. If you don't like it, contact your MP.

As well, the Supreme Court has enshrined as a constitutional principle under section 7 the fact that young persons (under 18) are entitled to a presumption of diminished moral blameworthiness for the crimes they commit (i.e. lighter sentences.) It is now a Charter right.

Not if they commit murders or violent robberies. There is NO EXCUSE for this, no matter if they are teenagers. Murder is murder, and not only should they do the time for these crimes, we should know who they are. There simply is no excuse for protecting their identities. The way some of these politicians think is very scary and shameful. I was a teenager once, and believe me, teens know that murder is wrong, just as much as adults do. If you think differently, then I am very, very afraid of the people running our country. If teens don't realize that killing is wrong, get them out of our homes and put them into institutions, because they are mentally unstable.


You have some good points.

However I'm quite sure that some pretty smart people designed the systems and laws that are now in place.

I suggest that if you want the laws changes you do some lobbying, get some education and do some research on how to improve the system so that the children who are salvagable are saved and society benifits in general from your proposed changes.

The JDA put too much power in the hands of the judge. Sentencing was very different district to district. The rulings handed out by judges under the old JDA would not pass Charter challenges for "cruel and unusual punishment". There are problems with Canada's youth criminal justice system, FOR SURE, but the new YCJA is a GREAT improvement on both the JDA and the YOA. Does it need more work? Yes. Is it still too lenient on violent offenders? Yes. Is it still to lenient on repeat offenders? Yes. But it's a solid step in the right direction.

Given the Justice system as a whole in this country..... I'm sure we could live without the YOA.
We have repeat sex offenders on the streets, convcted drug trafficers, murderers, you name it, If rehabilitation/reintegration is the aim it has failed.
I say old enough to do the crime then old enough to do the time and face the publicity

I did Juvie time on the East Coast, I wasn't rehabilitated, I grew up, and yes the YOA saved my ass from more time more than once, I'm sure my scentances in the 2 instances would have been compareable in the adult system.

I somewhat believe in the Youth Criminal Act, but would strongly support amendments and perhaps a complete scrap/replace.

One reason I support it though is, well, we shouldn't ruin a potential future employee in the first quarter of his life.

People *do* change. Some people don't. I don't like paint brushes. Our factory-styled fashion of dealing with problems leads to many more issues, which is the case here.
