Iam a union member, but not buy choice, the company I work for is a union company . I much dislike the union . The question I have to ask is this. Has any one ever taken thier union to court to have thier dues refunded due to no repersentation. USW 7135 refuses to answer any call email or fax sent to them, nor dose the head office of USW. This is over a WSIB claim
Any thoughts or ideas? Dose any of you know how to bring charges against the union via union laws? Has any one taken thier union to small claims court?

PffffffftttttttBwwwaaaaHahahahaha!

Good luck with that! Unions are 'about the workers' (plural) but 'the worker' is expendable for 'the greater good'. Your union rep cares about their own pay cheque, not yours.

Gee ya know if you flapped your mouth like that around the shop I'd have to advise you to threaten the shop steward you'll file a complaint and expect the smallest most minimal help they can deliver....
Fuck the faxes and emails, have you even filed a grievance over your claim on paper? That's how you do it, go to the steward and say my claim got denied, I want to file a grievance, let's file the papers.
First.

Tell your union to hand over a paper bag with $500,000 cash in unmarked, nonsequential $50s and $100s or else your former boss will have to prove he didn't offer to blow you in exchange for a promotion.

Good luck, I find dealing with my union a pain in the ass.

Hell I had 5 grievances filed against me by one guy because I told him to stop slacking (he kept leaning on his shovel and wouldn't stop talking), I was working faster than he was fast (he said I wasn't working as a team), I told one of my co-workers to get off the machine because he was jacked up on cocaine, and because I said I didn't like the union. He filed the not working as a team against me twice.

My favorite quote he ever said to me was "Well.. ah, that's the difference between you and me... You're production and I'm union"

Pretty sure you cant withold union dues...the whole dues check off system is the result of court decision:

Quote:
In Canadian labour law, the Rand formula (also referred to as automatic check-off) is a workplace situation where the payment of trade union dues is mandatory regardless of the worker's union status. This formula is designed to ensure that no employee will opt out of the union simply to avoid dues yet reap the benefits of the union's accomplishments (such as ensuring higher wages, better job security or other benefits). Supreme Court of Canada Justice Ivan Rand, the eponym of this law, introduced this formula in 1946 as an arbitration decision ending the Ford Strike of 1945 in Windsor, Ontario.

But theres hope for you yet:

Quote:
If there are religious objections to paying dues the dues may be donated to a mutually agreed upon charity per Canada Labour Code Section 70. (1)

So you could always convert to another religion in protest!

what is WSIB? is that a workers compensation board? if so, why do you feel a union is obliged to represent you? the rest of the country gets a lawyer.

Although,I've heard of unions assisting in WCB claims, their responsibilities ly in representing you to your employer.
