As I read the article it seems the USSC declined the case over a chickenshit procedural issue when the larger issue of free speech was ignored.

Seems the less chickenshit thing to do would be to wait for the verdict in the civil suit and then appeal it. Taking it pre-emptively right to the SCOTUS to short-circuit the suit altogether comes across as fairly gutless. It's not like NR and it's ultra-wealthy billionaire backers can't afford to pay the best, the most luxurious!, of lawyers.
