I think the point I'm getting at here is that in the American case the guy committed a premeditated act over a number of years with the full intent of causing as much harm as possible. In the Canadian case there was no proof of premeditation and it also involved substance abuse, not some one who carefully planned to cause bodily harm. Sure there some faint similarities’ such as both being ethnic minorities and both involved children who suffered but beyond that it's a pretty poor comparison.

I'm not sticking up for up for the guy nor am I saying being drunk should give him a "get out of jail" ticket but the two cases are about as different as they can get.

Great post! I don't agree with you very often, but I can't disagree with you on this one!

One thing that hasn't been mentioned is the title of this topic.

"Canadian vs American Justice."

Whatever one deems the merits of the case, at least in Canada, we don't yet see lines like this in court reports;

"Mansa Musa Muhummed was sentenced yesterday in Riverside County Superior Court, nearly a decade after his arrest. A judge imposed seven consecutive life sentences and nearly 17 years of other prison time."

Why the fuck does it take a decade to convict somebody of an offence down there?

At least in Canada, we have some kind of expediency. About 18 months is the maximum time it takes to bring a person before the court, unless there are extremely extenuating circumstances.

Jimmy said she's also upset she can't see or talk to Pauchay because of a court restraining order. Pauchay faces a further charge of domestic assault against her.

"He was just such a good dad. I just love him and you guys are taking him away from me - the only person who can actually feel what I'm feeling," Jimmy said through tears, sitting across the circle from Pauchay. "What kind of society is that?"

I believe the English language has no real word to express the sheer...rage I felt reading that...

HE KILLED TWO OF YOUR FUCKING KIDS (they are with her, right?) I mean, what the fuck?

And I love this statement by Mr. Douchebag Murderer

Later, raising his voice, he spoke about his third daughter, born a few months after the tragedy. Social Services has since put her into foster care. "That's all I had left and you took her away. My rights didn't matter," Pauchay said.

You're playing victim? You? The guy who let his two kids fucking freeze to death. Not something quick, but a slow, painful death, and YOU ARE PLAYING VICTIM? What the fuck? Seriously, what is the matter? What's with this bullshit victim mentality here? The fact that you're basically getting off for murder in this "spiritual guidance" BS is laughable. So if I went off and killed you, do I get a life sentence of attending Roman Catholic church services? Seriously.

There's so much bullshit right now...GRRRRR

Well said. What laughable crap. If this guy isn't put in the pen for at least 10 years the outrage around the country will be palpable.

I think it should be a life sentence. But I have to be realistic. Sadly.

Take the bastard, put a t-shirt and diaper on him and throw his worthless ass under a fucking snowbank! Why does he deserve better treatment than what he gave to his kids? It really pisses me off when people can do harm or let harm happen to their kids in this manner and get a slap on the wrist!

(I know, accidents happen, but this is not an accident, this was negligence!)

This was negligence to a degree most of us cannot even being to imagine. Taking your INFANT children out in the FREEZING weather when you're DRUNK as hell and then allowing them to die as a result. It enrages me beyond belief. And for this guy to beg for mercy now - the very thing he denied his children - is the height of audacity.

We lower standards in society so much as it is, stating that "well it's understandable", or "the poor guy, had a hard life." Give me a f-ing break. This is utterly inexcusable and if we can't say we expect parents to take proper care of their children then what have we regressed to?

LOL! I know you're kidding, but the fact that people actually make this argument just SICKENS me... valuing human life is a universal goal. Let's just pray this judge does the right thing and sends the right message here! :o

You are a lawyer, right. What would happen to someone who smokes in bed and burns down the house, killing two children?
