Quote:
Crown prosecutor Michel Audet had filed a motion asking that Payne be declared a dangerous offender, but Payne’s defence lawyer James Cocciardi successfully argued the same move had been tried at Payne’s last trial for assaulting a woman but failed because expert reports said then that Payne was starting to mend his ways by taking part in substance abuse programs in jail.

He was sentenced to six years in July 2008 for that assault. The sentence he received Tuesday is to run consecutively, meaning he has a total of eight years to serve.

In 1993, Payne was convicted of manslaughter in the death of his girlfriend’s 2 1⁄2-year-old son and was sentenced to four years in prison.

How does this not warrant a dangerous offender charge?

Because in the liberal view of the world, Payne is the victim and those he murdered and maimed are mere collateral damage...

Whenever I read stories like this I think of the indignation raised whenever we look to some other 'barbaric' nation that charges the woman for her own rape and then stones her to death.

7 years for beating a child to death is just as autrocious.

Payne received seven years in prison for the 2006 beating of one of his crack-cocaine customers who was struck with a metal bar, punched and kicked and had boiling water poured on his naked body. The 30 months Payne served awaiting sentence counts as double, leaving him two years left to serve for that crime.

Now that's something everyone should be outraged about. Regularly defendants in criminal courts get "two for one" credit for their time spent in custody before they're formally sentenced. Many defendants drag out this time as long as possible before pleading guilty in order to maximize that credit.

It's preposterous and Parliament should outlaw it immediately.

So where is the part where he was apparently turning his life around? The judge makes this claim then all we hear is how he has been beating and killing people for over two decades. This is disgusting.

Anyone know what the justification for "two for one" is?

The idea is that the short term holding cells are overcrowded and they offer none of the programs or facilities that a regular prison might. It's a huge bloody loophole and it should be removed. Then we'll see the revolting mouthpieces for the criminal gangs move quickly.

Bastard should have gotten life for the killing of the child. Future incidents would not have taken place at all if he was where he belonged to begin with.
