CBC News wanted to use the real name of the sex assault victim who was jailed. We wanted to show you her face.

'Angela Cardinal' was a young, pretty, Indigenous woman. A photo taken of her by police in June 2014 shows her curled up on a leather sofa in a "soft interview" room, looking shyly and sadly into the camera.

The picture was snapped just hours after Cardinal fought for her life against sexual predator Lance Blanchard. She was questioned by police following her release from hospital where she was treated for extensive injuries.

There's a blanket on her lap and a long piece of bloodstained gauze in a heap beside her.

In April, her mother wrote an affidavit asking the court to release her name. She wanted her dead daughter's story to resonate and be heard.

The mother of the sex assault victim wrote in an affidavit, 'It is important that (she) be named so that she is not simply another statistic.' (Zoe Todd/CBC News)

"I believe it's important that [she] be named so that she is not simply another statistic,'" the mother wrote.

"I want people to understand what happened to her and to hear her story. I believe that this is what she would have wanted as well. [She] was very proud and could stand up for herself. She was a strong person. She should have a voice."

With the permission of Cardinal's family, CBC was prepared to go to court to ask for the posthumous publication ban to be lifted.

When think about all the people involved in the treatment of this woman, from the crown to the judge, to the courthouse staff and law enforcement it's really disheartening to ask: not one person thought this was wrong? Not one person thought to speak up? This cant just be a random isolated problem when so many people are involved. This story wouldn't have happened if the woman hadn't been indigenous and living on the margins of society.

I figured this was the situation that Simons and then the CBC never bothered looking into before they set off this firestorm. Why would any judge order a witness or victim put into custody if he/she didn't believe they were a flight risk and that the case in front of the court would completely collapse without their testimony?

More than meets the eye to this particular situation. The initial over-reaction is pretty irresponsible, especially by the Journal and their "star" columnist.

As a society, we're so quick to be outraged even when all of the facts aren't available.

The judge is no a racist villain, but he's not a hero either. The story in Caleb's link suggests that the proper process (or best practice) to remand her may not have been followed. She was it seems ordered to be remanded solely at the request of the crown based on info supplied by the crown; the problem being the crown is not an impartial actor. It seems that perhaps there should have been a separate hearing where the crown would be required to present a compelling evidence-based argument for her detention, and she would have an advocate able to challenge that argument and evidence.


At any rate, the bigger issue here is that the legal system has no way to deal with mental health and addiction except to treat the people suffering from those conditions as criminals. The "war on drugs" mentality still views these people crooks who need punishment rather than patients who need treatment. Why can't they arrange for people like her to he held in a hospital or group home instead of a prison cell?
