there is a easy way to get around all this, a nice sign "please do not smoke within 10 feet of the door" then when this douche bag comes back, he will fall under the TPA if he decides to smoke right in front of the door, all it takes is one offense to keep this idiot off your property for the rest of his life.

I see people abuse them all the time. At school you are not supposed to smoke within 100 ft of the doors....people smoke half way out the doors.

It is the same thing down here at UNB. The signs say no smoking within ten metres of the door, but people still do; staff and students alike. The guy suing is totally being a douche about it though. I mean seriously, you're blocking the door. I bet he was asked politely to leave at least once and put up a fuss, then figured he could get some cash out of the situation.

what the sign does is make the restaurant owners legal position better. If the guy fights his trespass, the owner can say, 'hey, i've had that sign up for a long time now etc'. One of those cover your own ass sort of things.
