I cannot believe that they would even have considered charging him. Is there no other crime in SC worthy of police attention?

YES! Ok, when has smoking weed been considered a "performance enhancing drug"? And if he can smoke and still be get gold medal in the world olympics...it proves two things.

-Smoking weed really isnt that bad for you
-He works harder then other athlete's because he smokes, so he shouldn't have any consequences.

Just a question...
Why is this any different from smoking around a minor, who lit up one herself?

Crime is crime, right?

The Ontario offence of smoking in a car with a minor is not a crime. It's a ticketable offence under Ontario law. But it's not a criminal offence. It's like a speeding ticket. If you get that ticket, you don't get a criminal record. Important distinction.

And while Phelps, if he was smoking pot, is technically breaking the law, the police don't have unlimited resources. I would like to think that they have better things to do than prosecute (persecute?) people for such trivial offences in a case like this where they don't even have any good evidence.
