The scary part of this is that obscenity charges are determined at a local level. Community standards determine what is obscene.You can make a picture in one part of the country where no one cares. If that picture ends up in a part of the country where a grand jury can seat a bunch of blue hairs, someone is going down. Transmitting obscene material across State lines becomes a federal matter. The feds can pick what local jurisdiction they choose to pursue the matter. They can "jury shop" for the perfect climate to get a conviction. You might be surprised at the number of people who are doing time on obscenity charges in the States. Its a lot more than you would think. Unless you are Larry Flynt, it does not make the news.
