I agree with the courts, that he should stay away from her and her mother, but when he is footing the bill for a home that he owns alone, she should not have the right to stay, the courts have defacto given her the house until the order is lifted.

What would happen if he reentered the house at a time when it was vacant? Or is he not allowed to go near it either?

The 'dwelling address' will also be on the restraining order. He has to jump thru all the legal hoops to have 'residency restored'. Until then, if he enters within x # of feet of either 'persons or property' as listed it's 'crowbar hotel' for him!

This is why a lot of guys get pissed and refuse to commit to a woman...she can accuse him of assault and basically get everything until it is resolved in court which can take forever......I wonder how the lady in question would feel to come home to a for sale sign....fuck all she could do then

you hit it stokes...mind the pun...ALLEGED assault.

she screams abuse and whether it is substantiated or not, this guy gets the short end of the stick until everything is sorted out.

I would like to see if he levels a civil suit against this chick when this is all done....AND HER MOTHER TOO.. heh..sorry had to.

She is safe right where she is! The court order takes precedence.
It is going to cost him $$$ no matter ho this plays out. ie; he has to pay lodging for himself elsewhere in the meantime. She will be required to move out with no compensation as they didn't live together for 1 year. He could quiote possibly speed things up by going to court and offering to help her get moved into suitable accomodation within her childrens school district. The judge would see this gesture as more than reasonable, and if the woman turned the offer down she would then likely be issued an order to vacate. At her own cost.

The first 9/10s of a modern news story is where they hype the story. The more pertinent information is usually in the last 2 paragraphs.

He messed up by asking her to move in under those circumstances. In SC, they would have been classified as common-law married after the first 24hrs of co-habitation as a couple. Even allowing girl-friend to receive mail at your address is enough grounds for her to claim common-law status.

Be careful what you ask for :)

Given that warped logic, if I steal your car and fill it up with gas, when it needs it, I get to keep it. [huh]

Gotta love our fair, impartial judicial system. The only way the court will ever have any sympathy for this poor slob, is if he commits a major crime and gets convicted. Then he might just get his home back.

Were they married? Legally? That has a central impact on the issue of the house, because our common-family law defines and divides the matrimonial home EQUALLY.
