Alcohol isn't considered a controlled substance, drugs are. This is why Byfuglien likely refused to give a boold or urine sample and why the charges weren't dismissed. Had it been just alcohol, this matter might have been dropped, something I don't agree with, as operating a motor vehicle while under the influence of alcohol, illegal drugs or even prescription drugs is a reprehensible and irresponsible act.

Whether or not you agree with the drug policies of the Americans, Byfuglien broke their laws in their country, and has to face the music in their courts according to American law.
