In Canada you can get a divorce in the case of cruelty, adultery or separation for a year. Does that make sense? Shouldn't you be able to get a divorce any time one party wants one? Couples whose government doesn't recognize the Canadian marriage can now get a divorce as well, but only in cases of separation. Ie they can't claim cruelty or adultery as reasons. Does that make sense.

I don't think adultery or cruelty are used that often, because the burden to prove it is pretty heavy. Usually, what is used it "irreconsilable differences" and from what I understand, your divorce will be final a year after you filed.

You have to be separated for that year. Do you think that's the right restriction to put on divorce? Personally I would make divorce easier and marriage harder to obtain.

Canada does not have an official "separation" thing. I mean, you can't go to court and file for separation.
From what I understand, that year is there for people to be able to reconcile.
Also, you do not have to be divorced to have custody, child support and spousal support arrangements. You can be "separated" forever, without ever getting divorced.

I know a couple who divorced and the reason was adultery... but neither him nor her had cheated.
A woman friend of the couple even went to court and lied, under oath, that she had sex with him.

That's the point if people want to divorce before being separated for a year - you have to resort to bullshit like that.

Not saying I agree with the law, divorce should be granted when asked for.

When I split up with my ex, we set up child custody and everything else between the two of us.
Three years later, my ex told me she was filing for divorce... I never even went to court and only showed the papers she sent me to a notary friend before I signed them.

Good job. Too bad more people can't do it like that.

When I got my divorce, I just went down to the Stationary store, paid $50.00 for the paperwork. We filled it out together and signed it. She took it to court, the Judge read thru it, and asked her" Do you agree with all this"? She did. "Divorce granted"!

Today ( like as of this past Friday) a family member has filed for divorce under irreconcilable differences'. In the prior 12 mos. their separation agreement was reviewed and 'tweaked' by the Judge :lol: and then approved.
