This is where people who think DNA can solve every crime are wrong. What would DNA prove? AFAIK, there's no dispute that this guy was at the scene, just that somebody else fired the gun. Absence of DNA doesn't prove he wasn't there - where exactly was he supposed to have deposited his DNA? And presence of DNA wouldn't prove he did the crime unless the prosecutions case is that he was the only one there except for the victim.
But this is the kind of case that should give the pro-legal murder people pause. All this "we should only execute if we're sure the person is guilty." Well, doesn't look too sure in this case.
