The radical Muslim cleric Abu Hamza must be deported “immediately” after losing a last-ditch appeal against his extradition to the US to face terror charges.

Abu Hamza and four other suspects including Babar Ahmad, a British man who, as an alleged terrorist fundraiser, has been in prison without trial for the past eight years, challenged the home secretary’s decision to deport them. They argued they would face inhumane conditions in US prisons.

These claims were dismissed on Friday by Sir John Thomas, one of England and Wales’ most senior judges, and Mr Justice Ouseley.

Their decision follows a European Court of Human Rights decision that the suspects’ human rights would not be violated by deportation to the US.

“We have?.?.?.?concluded that each of the claimants’ applications for permission to apply for judicial review or for a reopening of the statutory appeals be dismissed. It follows that their extradition to the United States of America may proceed immediately,” Sir John wrote in his judgment published on Friday.
