The judge says the woman’s niqab “masks her demeanour and blocks both effective cross-examination by counsel for the accused and assessment of her credibility by the trier of fact.”

    It will take longer - she's appealing the judge's decision. Again.

    The principle of the ancient Common-law that everyone has a right to face your accusers predates Canada, even New France.

    That said, this is a sexual assault case. The accuseds in this matter are probably using this issue to further undermine the ability of the victim to provide a robust defence of her testimony during examination-in-chief.

    Hopefully she can give video evidence instead or some more common accomodation we routinely use for vulnerable witnesses.

    Some times points of law and legal debates can miss the heart of the matter.
