If I understand correctly that's not what's happening.
The point of myself and others was there was never the evidence of premeditation or malicious intent to murder to make that fly.
So we were right, then.
It would still be an interesting case if he didn't cop a plea. I imagine he will though. Sounds like they're open to adjusting the charges. Perhaps that's why they lowered them here. I'm going to guess the decision has already been made.
1st degree murder (premeditated) is a tough case to make in court. The civil rights charge can still put this guy in prison for the rest of his life and that makes it a safer bet for the prosecution than murder one.

Hate crime is federal jurisdiction, murder is state. Getting charged with one crime doesn�t exclude getting charged with the other. And AFAIK he�s already charged with first degree murder.
