Give him a slap on the wrist to show we don't condone vigilantism. A Conditional sentence that means he has no record if he keeps his nose clean for a period, maybe does some community service.
What dad better hope is that what he did doesn't wind up resulting in a lesser sentence for the driver - I believe we've seen that before.

Can't fault the guy and I bet the police were reading from a prepared script while rolling their eyes and hiding a grin.
Unfortunate reality though is that the driver will sue him and likely win.
