The 16 year old will likely be sentenced as a juvenile, which means his record dies when he's 21. That's the point of juvenile laws - to protect kids who do something stupid but deserved another chance.

What does the govt looking at the big picture mean? Either they charge him or they don't. Do you really want them to just drop it? Charging is a long way from being found guilty. The boy may have the defense that she told him she was older. If convicted, since men get 3 years for raping their kids over a number of years, he may get no custody time at all, just house arrest, which would seem appropriate.

This guy's got no class, as I pointed out. Screwing 12 year olds at 16 just isn't done.

As for alcohol. Meh. There was plenty of drugs and alcohol in my life at 16, and I grew up eventually to be an upstanding citizen who doesn't use. Plenty of sex too (tho it never seemed enough) but as I said, not with 16 year olds. But in those days, if you had long hair and your own place, as I did, it was pretty easy. There were ads in the Georgia Straight of girls/women looking for guys with "beautiful long hair." Never had to use those ads tho, just wander around on 4th avenue, my freak flag flying. Just had to look out for Stedanko.

Also you kind of send a message when you charge the victim of rape with underage drinking. In a way you are saying it's your fault if you hadn't been drinking this would not have happened. Which of course it is not her fault. I seriously dought she will be charged with underage drinking.

I'm thinking those kids who watched MIGHT get charged if it can be proven they were drinking. But seriously if its like the USA they get a ticket with a fine. Wow underage drinking is like doing 10mph over the speed limit. Thats the msg it sends here.

The police have said in so many words that the girl consented. Initial reports turned out to be way hysterical, including that she was screaming for help, or that the other kids were watching and taking pics. Neither is true.

The male is still a child too - can't be held to the same standard as an adult. I think he's a bonehead. But, at 16 I was certainly thinkging with my dick, not checking girls for ID. In those days tho, 12 year olds looked like 12 year olds, not like going on 21.

So since we are opening a can of worms, underage drinking is illegal, selling booze to underage people is illegal, stealing booze is illegal (dunno if they bought it or not ), being on fb under 13 needs parental consent, which might be where child protective services comes into the picture... She might have mentioned she was 15-ish, so he didn't know she was 12...
