Well if he can find a lawyer who'll do it on a contingency basis,then try it. Only he can place a value on his time.(I figure he's going waste a lot of it).

what a load of crap, its voluntary assumption of risk. you don't always win, and the burden of proof falls on Kusznirewicz to prove the machine said what he claims.

That and he played a machine that he knew would not pay out that much under the best of circumstances. For him to win he would have to prove that that particular jackpot is available on that series of machine (not bloody likely on a $0.02 machine). Plus if what the OLG is claiming is true about the Alchohol and Gaming Commission of Ontario having a rule saying any wins caused by a malfunction are void, then the court's hands are tied.

No chance. It says right on the machine that a malfunction voids all pays and plays. That is written into the terms and conditions of operating a casino.

The best way to handle this, would be to pay the guy the maximum payout of that machine which would be just over $9000, OLG has tonnes of cash anyway and that should settle this case. I dont think there is a snowballs chance in hell that the court would give him more than that if he could possibly win the court case.

probably not a bad solution..

any pics of the machine showing a 42mill win though ?
