raydan raydan:
Why not, I can be a smoker one day and a non smoker the next.
As can I. And my life insurance policy will reflect that. One year after I have quit, and when I have submitted a bronchoscopy (or doctor's certification that I have received them) showing a plateauing of tar build up, if not an outright reduction.
For this topic, I can walk into a doctor's office, be out in 20 minutes with a note, and have new, discounted, car insurance by the end of the day. I'm out of pocket $50 and change...not that that matters, I just got a $200 discount on my car insurance.
I wish I was joking, but this has already been done, in Alberta.

How long until lawsuits come out over it?
The problem is the laws, and how they can be contradictory with one another, not with what people want to identify as.
