Groening, who now lives in B.C., was given a 30-day jail sentence for theft under $5,000 earlier in 2010 in Stettler court. Co-accused Rosenthal pleaded guilty last June to theft under $5,000 and was given a 15-day jail sentence. Dewald, another co-accused, was fined $400 for theft under $5,000.

So the real criminals get almost nothing, while the guy protecting himself gets 90 days.

He'd have gotten the same charge even if he didn't leave the yard, this time it would be for discharging his firearm instead.

Laws need to punish the real cooks, not the people trying to protect their property.

In our system the risk of death by homeowner is about the only thing that would prevent them from actually trying to steal anything. The current system just lets them off in under a month no matter how many times they get caught.

You can use reasonable force to protect your property. The amount of force you use has to justified. It's a tenet of Common-Law going back centuries. Every situation is different so there is no measurable factor that makes 'reasonable force'. A judge or a jury have to decide that, never a good spot to be in.

What this owner did and tried to do to the thief was not reasonable. He was charged and convicted for his actions and rightly so.

I agree that offenders get off with a slap on the wrist at times but trying kill people who steal your property is very wrong.

Shoulda used rock salt instead of buckshot. Stings just as bad but nowhere near as lethal unless you aim it at someone's face from two feet away.

The chasing them down and then shooting them was a tad extreme. setting the dogs on them in your yard would be much more entertaining...then if one of the pups are hurt you have an excuse to shoot the bastards.

Actually he was bitching about the inadequate sentence. You know, lawn order. Something I thought y'all good ole folks out dere were big on. Not when it's vigilantism I guess.
