MONTREAL - The appeal of the verdict in the case of former cardiologist Guy Turcotte is to begin in Montreal Monday.
In 2011, Turcotte was found not criminally responsible in the 2009 stabbing deaths of his two children, Anne-Sophie, 3, and Olivier, 5. Turcotte had been charged with first-degree murder.
The Crown plans to argue before a three-judge panel at Quebec’s Court of Appeal that the verdict of not criminally responsible should not have been presented as an option to the jury. It wants the court to order a new trial.
Turcotte was released from a psychiatric facility in December after 46 months in custody.

After following the initial trial and hearing the "not criminally responsible" verdict, I could not believe my ears. This could not be happening, not in our civilized society. Our justice system has been downgraded to mediocre status at best. This fellow literally murdered two innocent children in 2009, his own children at that, and he is now a free man. The only way to provide justice to the victims (his murdered children) here would be to convict Mr. Turcotte of Capital Murder. But unfortunately Canada does not have the death penalty. Therefore he needs to spend the rest of his life in prison.
There is the likelihood that the defense team will try and use the "Double Jeopardy" argument to try and avoid a retrial. However, the court of appeal needs to use whatever arsenal at their disposal to overrule/discredit this argument and allow the re-trial. Justice needs to take it's course here as it's long overdue.
