The police constable charged with second-degree murder in the shooting of 18-year-old Sammy Yatim aboard a streetcar last summer has returned to work with the Toronto Police Service, despite an ongoing inquiry into the case against him.

    I guess that you couldn't be fired from any job for simply being "accused" but this guy is policeman (not just any job) and he is being accused on second degree murder (not just any old charge). I would say that if he is found innocent, re-instate him with all of his back pay owing. If he is found guilty, not a nickel more to him, no back pay and burn his uniform out back. This in-between solution doesn't smell right.

    He's not been convicted of anything.

    They're paying him anyways, might as well get some work out of him.

    In the interest of fair play they shouldn't be allowed to suspend him based on an accusation even if the video implicates him in the commission of a murder.

    The job he does should have no bearing on how he's treated and if they didn't deal with him in this manner the TPS would be open to all kinds of criticisms from the public and could actually jeopardize their case against him by passing a sentence before he'd been tried and found guilty.

    But, and this is big but. He should have to be out on bail same as anyone else who was implicated in something like this and just because he's a police officer he get's a pass which is bullshit. If he was one of Rob Fords Buddy's from Jane and Finch he'd still be rotting in a holding cell not walking the streets.
