How is it a breach of liberty?
Its not just a breach of liberty, it is a specific charter right.
8. Everyone has the right to be secure against unreasonable search or seizure.
The moment you start to drive erractically
for any reason the stop is no longer unreasonable.
And here's where your charter argument falls completely apart. It's not unreasonable search and seizure. Pulling someone over they
suspect of driving impaired is part of their job n'est pas?
However, the gov't could make it easier by introducing "whiskey plates". This would make it way easier for police to instantly identify previous offenders and do a cursory spot check. Just to make sure the driver is keeping up their end of the deal.
Then when a whiskey plated driver gets nailed again, they not only lose their vehicle and licence permanently, they also get some nice jail time.
