Not really. You may not have intended to kill someone but you were definitely out to hurt them.

second degree murder
n. a non-premeditated killing, resulting from an assault in which death of the victim was a distinct possibility. Second degree murder is different from first degree murder, which is a premeditated, intentional killing or results from a vicious crime such as arson, rape or armed robbery.

Aside from all the weapon related charges, it's interesting that this thug had no problems with shooting someone right in front of the police. Obviously, the threat of a weak fine and house arrest are not an effective deterrent.

As unfortunate as it is, I'm still amazed that this is the first one in 30 years for Whistler.

But yeah, gunning a guy down in front of a cop, it's almost worthy of a Darwin award. The way it sounds in the article, it souds as though something like the following happened

Hahaha., Just heard on the radio: The punk just got out of jail in Sept. and is "known to police". He's also under a gun ban because he shot someone before.
I guess we can assume that it was an illegal handgun?

I'm sure there will be a lot more murders to come. Crime here is getting out of hand and the police/courts are mostly useless.
